CLASS CONCEPT/FUNCTION

This is the second class in the Environmental Enforcement Compliance Specialist Series. Positions in this class function as a lead worker for an environmental program and are responsible for investigation and inspection of allegations of violations of environmental laws. Positions typically investigate and prepare complex cases relating to violations. This class is distinguished from the Environmental Enforcement/Compliance Specialist by its responsibility for reviewing the work of Specialists and handling the more complex violations or for agency-wide responsibility for the management of all cases ...............

 

DISTINGUISHING FEATURES OF THE WORK

Complexity of Work: Performs work of considerable difficulty which requires the investigation and preparation of complex cases for prosecution of violators of environmental laws. Interprets and applies environmental laws in the investigation and documentation of cases; researches the effects of violations on the population and environment; assesses fees to be imposed on violators to recover damages by using a predetermined formula; and negotiates preliminary agreements in the resolution of cases. Provides technical assistance to industry to assist with compliance with agreements. Analyzes and reviews monitoring reports of regulated industries. Evaluates internal controls to determine the reliability of reports used as evidence for prosecution. Determines violations to laws by analyzing and reviewing data. Prepares comprehensive reports explaining irregularities and citing violations.

Supervision Given: May supervise Environmental Enforcement/Compliance Specialists.

Supervision Received: General direction is received from an Enforcement/Compliance Specialist Manager or a higher level program manager.

 

Scope: Investigates records and documents and performs on-site inspections statewide or within an assigned area to ensure that establishments are within approved guidelines and/or permit limits for the industry regulated.

Impact of Actions: Successful job performance ensures environmental protection by monitoring compliance with environmental laws and requiring the application of policies that may lead to penalties if regulated establishments are not in compliance with applicable laws and regulations. Errors may allow violators to go undetected and pose threats to the environment.

Personal Contacts: Frequent internal and external contact with the general public and regulated industries to respond to questions and concerns; with state environ-mental program specialists to collect and exchange information; and with the Attorney General's Office or outside attorneys to track judicial actions; frequent external contact with corporate and governmental agencies concerning violations and compliance issues.

 

KNOWLEDGE, SKILLS AND ABILITIES

Knowledge: Considerable knowledge of investigative principles and practices; federal and Virginia environmental statutes, regulations and standards; compliance auditing principles and techniques; and the principles of science as they relate to pollution of the environment.

Abilities: Demonstrated ability to plan and direct the work of subordinates engaged in investigations and compliance auditing work; to research documents for pertinent data; to analyze and evaluate data and draw conclusions; to communicate orally and in writing; and to maintain effective working relationships with the public, and business and industrial officials.

QUALIFICATIONS GUIDE*

License or Certification: None

Education or Training: Graduation from an accredited college or university with course work in the natural or biological sciences or a related field.

Level and Type of Experience: Experience in environmental investigative and/or compliance auditing work, use of scientific instrumentation and field sampling experience.

An equivalent combination of training and experience indicating possession of the preceding knowledge and abilities may substitute for this education and experience.
