CLASS CONCEPT/FUNCTION

This is the third class in a Mined Land Reclamation Series for positions located in the Division of Mined Land Reclamation (DMLR), Department of Mines, Minerals and Energy (DMME) that manage programs which regulate surface coal mining and reclamation operations in the enforcement, abandoned mine land, water quality, geology/groundwater, and client assistance sections. Positions plan and direct one or more programs in the assigned section and supervise professional and office support staff. This class is distinguished from the Reclamation Area Supervisor class by the latter’s supervisory role and oversight of a portion of the enforcement of abandoned mine land programs within an assigned geographic area. It is distinguished from the Reclamation Services Manager class by the latter’s overall management responsibility for section managers and their programs within the Technical Services/Permit Review area of the division.

 

DISTINGUISHING FEATURES OF THE WORK

Complexity of Work: Positions in this class perform work of considerable difficulty. Positions participate in the agency’s strategic planning process, develop section objectives in accordance with the division’s operational plan, prepare the section budget, and monitor and adjust spending during the budget cycle. Positions manage one or more programs to comply with surface coal mining and environmental pollution control laws, regulations and policies, provide direction to staff, establish priorities, assign work, adjust work schedules and monitor and evaluate activities to ensure accomplishment of section objectives. Positions provide oversight and regulatory interpretation to staff who apply expertise in hydrology, geophysics, geology, agronomy, ecology, water chemistry and other natural sciences for: permit review and evaluation; technical investigations in response to complaints concerning water loss or diminution, water quality, subsidence, landslides, potential mine blowouts, wildlife habitat management, soil management, revegetation and blasting; coordination of water programs delegated or assigned to DMME by federal and state agencies, such as the National Pollutant Discharge Elimination System (NPDES); reclamation planning for abandoned mine lands, realty, procurement of engineering contracting and construction services, and inspection of contracting activities; technology transfer and client assistance services; company corporate ownership and control investigations; administration of bond forfeiture

reclamation, the Small Operator Assistance Program and Lands Unsuitable for Mining petitions; development and maintenance of comprehensive data bases and tracking systems; and inspection and enforcement program activities related to coal exploration, pre-permit inspection, inspection of active and inactive permitted sites, inspection and surveillance of illegal operations, and enforcement actions to include issuance of notices of violation, cessation orders, patterns of violations, show cause orders, permit revocations and bond forfeitures. Positions ensure completion of documentation and reports, and maintenance of files and data bases; preside over or participate on committees and task forces; recommend updates and revisions to state mining regulations and agency policies and procedures; coordinate activities with section managers, other state agencies and the Office of Surface Mining (OSM); respond to ten-day notices issued by OSM; and may conduct public hearings or provide expert witness testimony in hearings and court cases. Positions are responsible for personnel actions in the section to include recruitment and selection, performance planning and evaluations, and training and development of subordinate staff.

Supervision Given: Provide general direction to subordinate supervisors and professional staff and general supervision to office support personnel.

Supervision Received: Receive directions from the Division Director or the Reclamation Services Manager.

Scope: Work affects surface coal mining and reclamation operations statewide.

Impact of Actions: Effective performance ensures the state’s continued regulatory primacy for surface coal mining operations and contributes to environmentally sound economic development and health and safety of citizens.

Personal Contacts: Frequent internal contacts with state agencies to coordinate programs and exchange information. Occasional internal contacts with the Assistant Attorney General to discuss legal matters, prepare evidence and testimony, and obtain approvals. Frequent external contacts with mine operators, engineers and contractors to resolve unusual problems and to discuss mining and reclamation plans, contract items or change orders, laws and regulations, and new technology. Frequent external contacts with the public to respond to complaints and inquiries. Occasional contacts with federal agencies to exchange information.

 

KNOWLEDGE, SKILLS AND ABILITIES

Knowledge: Considerable knowledge of federal and state laws and regulations affecting surface coal mining and reclamation. Considerable knowledge of surface mining and reclamation plans, methods, systems and procedures, scientific and engineering principles

and construction techniques. Considerable knowledge of federal and state laws and regulations governing procurement and grants administration. Working knowledge of mine safety and environmental pollution control laws and regulations. Working knowledge of management and supervisory principles and practices.

Skills: None identified for this class.

Abilities: Demonstrated ability to interpret surface coal mining and environmental pollution control laws, regulations, and policies and to evaluate reclamation plans, methods, systems and procedures and environmental data. Demonstrated ability to manage programs and budgets and to supervise personnel. Demonstrated ability to communicate well orally and is writing and to work effectively with mining industry operators and engineers, public interest groups, general public and federal, state and local government personnel.

 

QUALIFICATION GUIDE*

Licenses or Certification: None.

Education or Training: Graduation from an accredited college or university with major course work in natural sciences or related area.

Level and Type of Experience: Progressively responsible supervisory and/or management experience in related environmental or regulatory programs.

An equivalent combination of training and experience indicating possession of the preceding knowledge and abilities may substitute for this education and experience.
