CLASS CONCEPT/FUNCTION

This class is the fifth class and second directory level in the Alcoholic Beverage Control (ABC) Regulatory Management Series. Positions in this class direct the statewide enforcement activities of all ABC Regulatory Division districts and administrative support and special compliance enforcement. Positions in this class function as sworn law enforcement officers with full statewide police powers authorized by the Code of Virginia to administer and enforce ABC laws and regulations and all other criminal laws. This class is distinguished from the ABC Regulatory Assistant Director class by its greater supervisory and administrative authority over all field enforcement and regulatory administrative operations.

 

DISTINGUISHING FEATURES OF THE WORK

Complexity of Work: Performs work of unusual difficulty which includes: directing field operation activities of agents in all ABC Regulatory Division districts; directing the processing and issuing of ABC licenses to qualified persons and establishments to ensure that they are issued in a timely manner; monitoring compliance with the provisions of ABC laws and regulations with respect to the lawful manufacture, distribution, sale and consumption of alcoholic beverages by licensees of the Department; and monitoring the enforcement of the criminal provisions of ABC laws in accordance with the mission of the Department; developing policy and assisting in making decisions on assignment of regulatory personnel on matters involving security of ABC personnel and property by directing investigations of these matters; analyzing activity reports of field personnel in order to evaluate productivity and efficiency; responding to news media on matters regarding the results of investigations of violations of ABC laws and regulations, as directed by the ABC Board.

Supervision Given: This position supervises the work of Regulatory Assistant Directors and may provide guidance to other regulatory personnel who administer and enforce ABC laws and regulations and all other criminal laws, and provide administrative support services.

Supervision Received: Works under the general direction of the ABC Deputy Commissioner for regulation.

Scope: Work affects all aspects of the ABC regulatory enforcement program.

Impact of Actions: Decisions and actions could seriously impact the long term interests of the Department. Major costs in time, money, services, or public/ employee good will could be incurred if work is not performed effectively.

Personal Contacts: Frequent external and internal contacts with the highest level of law enforcement personnel; the Department’s Assistant Attorney General; applicants, licensees and/or their representatives; the general public; and the news media in order to insure the enforcement of ABC laws and regulations and all other criminal laws; to receive legal advice on matters involving ABC laws and regulations; to provide information or answer questions regarding ABC laws, rules and regulations; and to respond to questions regarding the results of investigations of violations of ABC laws and regulations, as directed by the Board.

 

KNOWLEDGE, SKILLS AND ABILITIES

Knowledge: Comprehensive knowledge of large-scale organizational functions, planning and program techniques; law enforcement planning and techniques; and public relations principles. Considerable knowledge of administrative and court procedures and systems, and laws and regulations affecting division’s operations

Skills: Skill in the use of law enforcement equipment relative to this job.

Abilities: Demonstrated ability to communicate effectively orally and in writing; compose reports; and to problem solve and make decisions. Demonstrated ability to evaluate performance or organizational units, and advise, direct and train individuals in their work and to exercise apprehension and arrest powers, and give court testimony.

 

QUALIFICATIONS GUIDE*

Licenses or Certification: Certification by the Department of Criminal Justice Services and a valid Virginia driver’s license.

Education or Training: High school graduation or equivalent with additional course work in law enforcement, criminal justice, public administration or a related field.

Level and Type of Experience: Considerable law enforcement supervisory experience.

An equivalent combination of training and experience indicating possession of the preceding knowledge and abilities may substitute for this education and experience.

 

CLASS HISTORY

This class was established in September 1988 as a result of the statewide Classification Review/Specification Update Program. It replaces the ABC Regulatory Division Director class. Class title change effective 7/1/94; formerly titled ABC Regulatory Director.
