CLASS CONCEPT/FUNCTION

This class is the fourth class and first directory level in the Alcoholic Beverage Control (ABC) Regulatory Management Series. Positions in this class direct the statewide field operation activities of all ABC Regulatory Division districts or provide administrative support and special compliance enforcement. Positions function as sworn law enforcement officers with full statewide police powers authorized by the Code of Virginia to administer and enforce ABC laws and regulations and all other criminal laws. This class is distinguished from the ABC Regulatory Regional Supervisor class by its supervisory or administrative authority over enforcement and regulatory activities in all ABC regulatory districts. This class is distinguished from the ABC Regulatory Director class by the latter’s greater supervisory and administrative authority over all field enforcement, special compliance, and regulatory administrative operations.

 

DISTINGUISHING FEATURES OF THE WORK

Complexity of Work: Performs work of considerable difficulty by directing field operation activities in all ABC Regulatory Division districts or by providing administrative support services. When directing field operation activities, performs work which includes: communicating with field supervisory personnel on behalf of the Director in regards to interpretation of ABC laws, regulations, policies and procedures; monitoring and participating in employment, training, performance evaluations and disciplinary action activities; participating in the preparation of the divisional budget by projecting financial, personnel, equipment and facility needs for field operations; serving as the final review for reports on contested license applications and criminal and administrative law violations; and reviewing ABC license approvals by the ABC Regulatory Regional Supervisor to ensure compliance with policies and procedures. When providing administrative support services, performs work which includes: directing the work of specially assigned agents statewide to administer and enforce ABC laws and regulations relating to suppliers of alcoholic beverages; developing and administering a variety of training programs on the divisional level as required by the ABC Board or mandated by the Department of Criminal Justice Services; directing the processing and issuing of ABC licenses to qualified persons and establishments in accordance with ABC laws and regulations; directing the procurement and assignment of all divisional equipment and supplies; directing the updating and dissemination of division policy and procedure changes; monitoring and participating in employment, performance evaluations and disciplinary action activities; and directing the development and preparation of the budget for the Regulatory Division.

Supervision Given: Positions supervise either Regulatory Regional Supervisors who manage the administration and enforcement of ABC laws and regulations and for all other criminal laws or other Regulatory Division administrative personnel who provide administrative support services.

Supervision Received: Receives general directions from an ABC Regulatory Director.

Scope: The direction of enforcement activities or administrative support affects the statewide ABC regulatory enforcement program.

Impact of Actions: Decisions and actions could moderately impact the agency in terms o time, money, services, and public/employee good will.

Personal Contacts: Frequent external and internal contact with the highest level of law enforcement personnel and the Department of Criminal Justice Services or suppliers of equipment in order to insure the enforcement of ABC laws and regulations and all other criminal laws; to comply with mandated training requirements; and to procure and maintain equipment.

 

KNOWLEDGE, SKILLS AND ABILITIES

Knowledge: Considerable knowledge of ABC laws, regulations and other criminal laws, regulatory policies and procedures; training certification requirements for law enforcement personnel; budgetary process; and procurement of equipment.

Skills: Skill in the use of law enforcement equipment relative to this job.

Abilities: Demonstrated ability to communicate effectively both orally and in writing; to exercise apprehension and arrest powers; to give court testimony; and to supervise the work of others.

 

QUALIFICATIONS_GUIDE*

Licenses or Certification: Certification by the Department of Criminal Justice Services an a valid Virginia driver’s license.

Education or Training: High school graduation or equivalent; course work in law enforcement, criminal justice, public administration or related fields.

Level and Type of Experience: Considerable law enforcement supervisory experience.

An equivalent combination of training and experience indicating possession of the preceding knowledge and abilities may substitute for this education and experience.

 

CLASS HISTORY

This class was established September 1988 as a result of the statewide Classification Review/Specification Update Program. It replaces the ABC Regulatory Division Assistant Director class. Title change effective 7/1/94; formerly titled ABC Regulatory Assistant Director.
