CLASS CONCEPT/FUNCTION

This is the second class and second supervisory level in the Alcoholic Beverage Control (ABC) Regulatory Management Series. Positions in this class supervise enforcement and regulatory activities in an assigned regulatory district or supervise and coordinate enforcement activities relating to suppliers of alcoholic beverages. Positions function as sworn law enforcement officers with full statewide police powers authorized by the Code of Virginia to administer and enforce ABC laws and regulations and all other criminal laws in a specific geographical district or area and supervise activities or coordinate special assignments. This class is distinguished from the ABC Regulatory Assistant Supervisor class by the greater degree of supervisory and administrative authority over enforcement and regulatory activities in a district or by the greater degree of specialized supervisory and administrative authority over activities related to suppliers of alcoholic beverages to include supervision of ABC Regulatory Assistant Supervisors. This class is distinguished from the ABC Regulatory Regional Supervisor class by the Regional Supervisor’s broader scope of supervisory and administrative authority over enforcement and regulatory activities in several regulatory districts.

 

DISTINGUISHING FEATURES OF THE WORK

Complexity of Work: Performs work of considerable difficulty by supervising enforcement and regulatory activities of assistant supervisors in an assigned district or by supervising assistant supervisors in a geographical area to regulate suppliers of alcoholic beverages. When supervising assistant supervisors in an assigned district, performs work which includes: coordinating and supervising work assignments and activities of ABC Regulatory Assistant Supervisors in assigned areas by coordinating special investigations; reviewing applications for ABC licenses and inspection reports within an assigned district for completion and accuracy; reviewing reports and other required documents and giving guidance to assistant supervisors and agents on investigation and other activity reports; submitting summary reports of district activity on a monthly basis; answering inquiries and letters of complaint pertaining to the ABC Department and other related matters as permitted within the assigned district; issuing instructions for investigations as needed; researching information and identifying the public’s needs, opinions and demands; developing priorities and making recommendations concerning changes in laws, regulations, rules, and policies and procedures; maintaining contact with local, state and federal officials to coordinate cooperative activities; conducting meetings with assigned personnel to keep them informed of policy, procedures and rules or any changes affecting the district; training, initiating disciplinary actions and r conducting performance evaluations for assigned personnel; supervising the investigation of illegal manufacturing, transportation, distribution, sale and possession of alcoholic beverages by those not licensed; supervising the storage and destruction of contraband within the district, as required by law; making recommendations as to further administrative action on contested applications; reviewing reports of applications for licenses and/or permits for clubs and suppliers; approving uncontested applications and authorizing issuance of licenses or permits. When coordinating and supervising work assignments and activities of specially assigned assistant regulatory supervisors in a geographical area to regulate suppliers of alcoholic beverages, performs work which includes: examining, analyzing and verifying accounts and records of suppliers to determine compliance with "tied-house" prescriptions and other applicable provisions of the ABC laws and regulations including payment of taxes, proper distribution of sale of alcoholic beverages, and activities; representing the ABC Board in the regulation of suppliers of alcoholic beverages, and communicating departmental laws, policies, and Board regulations to suppliers of alcoholic beverages.

Supervision Given: Positions supervise Regulatory Assistant Supervisors and may provide guidance to Regulatory Agents in an assigned district, as they enforce ABC laws and regulations and all other criminal laws; or may supervise ABC Regulatory Assistant Supervisors, or provide guidance to specially assigned Regulatory Agents to regulate suppliers of alcoholic beverages.

Supervision Received: Receives direction from an ABC Regulatory Regional Supervisor or ABC Regulatory Assistant Director.

Scope: Actions affect the compliance with laws, rules and regulations by applicants for ABC licenses, licensees and the general public and the protection and security of state-owned properties, employees, licensees and the general public in an assigned regulatory district or geographical area.

Impact of Actions: Decisions and actions could moderately impact the agency in terms of time, money, services, and public/employee good will if applicable laws and regulations are not enforced and properties are not adequately protected. Effective decisions result in the efficient use of resources and professional development of staff.

Personal Contacts: Frequent external contact with licensees, the general public and law enforcement personnel in order to enforce laws and regulations, and to provide education on ABC laws, regulations, policies and procedures.

 

KNOWLEDGE, SKILLS AND ABILITIES

Knowledge: Considerable knowledge of ABC laws and regulations, related laws, and laws of arrest; search warrants; rules of evidence; and court and administrative hearing procedures.

Skills: Skill in the use of law enforcement equipment relative to this job.

Abilities: Demonstrated ability to communicate effectively both orally and in writing; to supervise inspections for compliance with ABC laws and regulations; to exercise apprehension and arrest powers; and to give court testimony.

 

QUALIFICATIONS GUIDE*

Licenses or Certification: Certification by the Department of Criminal Justice Services and a valid Virginia driver’s license.

Education or Training: High school graduation or equivalent and course work in law enforcement, criminal justice or related field.

Level and Type of Experience: Progressively responsible law enforcement experience.

An equivalent combination of training and experience indicating possession of the preceding knowledge and abilities may substitute for this education and experience.
