CLASS CONCEPT/FUNCTION

This is the first class and the first supervisory level in the Alcoholic Beverage Control (ABC) Regulatory Management Series. Positions in this class supervise the enforcement activities of regulatory agents, or coordinate enforcement activities relating to suppliers of alcoholic beverages or to ABC licensees who show a significant deviation in the mixed beverage annual review (MBAR) process. Positions also function as sworn law enforcement officers with full statewide police powers authorized by the Code of Virginia to administer and enforce ABC laws and regulations and all other criminal laws in a specific geographical district or area, or statewide. This class is distinguished from the ABC Regulatory Agent class by its responsibility for supervision and/or coordination of work assignments to include supervision or guidance of ABC Regulatory Agents. This class is distinguished from the ABC Regulatory Supervisor class by the latter’s higher degree of supervisory and administrative authority over enforcement and regulatory activities of an assigned district, to include supervision of ABC Regulatory Assistant Supervisors.

 

DISTINGUISHING FEATURES OF THE WORK

Complexity of Work: Performs work of moderate difficulty by supervising agents in an assigned district, or by coordinating and leading the work activities of specially assigned agents in a geographical area to regulate suppliers of alcoholic beverages, or statewide to investigate ABC licensees who show a significant deviation in the MBAR process. When supervising Regulatory Agents in an assigned district, performs work which includes coordinating and supervising work assignments and activities of Regulatory Agents in assigned areas by directing field investigations and coordinating special investigations; monitoring public education programs; supervising the performance of regulatory inspections to determine compliance with the ABC Act, Board regulations and Virginia criminal laws; planning and supervising raids to apprehend and arrest violators of ABC laws and regulations and other criminal laws; and supervising Regulatory Agents in undercover operations to infiltrate

criminal elements to detect violations, obtain evidence, and ensure compliance with ABC and other criminal laws. Reviews reports and other required documents and gives guidance to special agents on the best methods and procedures for investigations and other enforcement activities; trains, initiates disciplinary actions and conducts performance evaluations for assigned personnel; supervises the investigation of the illegal manufacture, transport, distribution, sale and possession of alcoholic beverages; and seizes and/or destroys as required by law all contraband coming into the possession of the ABC Regulatory Supervisor. When supervising work activities of specially assigned agents in a geographical area to regulate suppliers of alcoholic beverages, performs work that includes examining, analyzing and verifying accounts of licensed distilleries, wineries, bond warehouse permittees and clubs to assure compliance with regulations, including payment of taxes; and investigating and making disposition recommendations to the regulatory administration concerning applications for club and supplier licenses. When supervising the work activities of specially assigned agents statewide to investigate ABC licensees who show a significant deviation in the MBAR process, performs work that includes analyzing MBAR deviations and conducting preliminary investigations to determine if there is sufficient evidence and justification to warrant a field investigation and audit of licensees’ financial records by specially assigned agents; guiding agents in all phases of conducting investigations and audits; recommending appropriate courses of action, which include conducting undercover operations within the Division, and in cooperating with other law enforcement agencies; assisting in the preparation and presentation of evidence in criminal and administrative cases; coordinating joint investigations with other law enforcement agencies; making recommendations to Regulatory Administration concerning changes in policies, procedures, legislation, statutes, and regulations as needed; and providing training to specially assigned agents in investigating and auditing MBAR deviations.

Supervision Given: Positions supervise Regulatory Agents as they enforce ABC or other criminal laws and regulations, or serve in a lead capacity over Regulatory Agents assigned to regulate suppliers of alcoholic beverages, or to investigate ABC licensees who show a significant deviation in the mixed beverage annual review MBAR process.

Supervision Received: Works under the general supervision of an ABC Regulatory Supervisor or ABC Regulatory Program Manager.

Scope: Work affects compliance with laws, rules and regulations by applicants for ABC licenses, licensees and the general public, and the protection and security of state-owned properties, employees, licensees and the general public.

Impact of Actions: Effective work performance results in compliance with applicable ABC laws, rules, and regulations. Decisions and actions could negatively affect the agency in terms of time, money, services, and public/employee good will if applicable laws and regulations are not enforced and properties are not adequately protected.

Personal Contacts: Frequent external contact with licensees, the general public and law enforcement personnel to enforce laws and regulations, and to provide education on ABC laws, regulations, policies and procedures. Frequent internal contact with other state agencies to exchange information, and to coordinate investigations and prosecutions.

 

KNOWLEDGE, SKILLS AND ABILITIES

Knowledge: Working knowledge of ABC laws and regulations, related laws, and laws of arrest; search warrants; rules of evidence; court and administrative hearing procedures; principles of accounting; investigative techniques; and management information systems.

Skills: Working skill in the use of firearms.

Abilities: Demonstrated ability to supervise inspections or to lead investigations and for audits for compliance with ABC or other criminal laws and regulations; to successfully complete law enforcement and other required training, to give court testimony; to exercise apprehension and arrest powers; to communicate effectively both orally and in writing; and to prepare investigative reports.

 

QUALIFICATIONS GUIDE*

Licenses or Certification: Certification by the Department of Criminal Justice Services and a Virginia driver’s license.

Education or Training: Graduation from an accredited college or university with major course work in criminal justice or a related field.

Level and Type of _Experience: Experience in the field of law enforcement that includes audits of financial records in the course of investigations.

An equivalent combination of training and experience indicating possession of the preceding knowledge, skills and abilities may substitute for this education and experience.

This class was established September 1988, as a result of the Classification Review/specification Update Program and revised December 1990, as a result of the MBAR law enforcement program. Class title changed on 7/1/94; formerly titled ABC Regulatory Assistant Supervisor.
