CLASS CONCEPT/FUNCTION

This is the single class in the Alcoholic Beverage Control (ABC) Regulatory Series. Positions in this class function as sworn law enforcement officers with full statewide police powers authorized by the Code Of Virginia to administer and enforce ABC laws and regulations and all other criminal laws in a specific geographical district; perform application, licensee, non-licensee and special undercover investigations; and inspect licensed premises to determine compliance with statute, ABC Board regulations and other applicable Virginia laws. This class is distinguished from the ABC Regulatory Supervisor Assistant class by the latter class’s responsibility for supervision and/or coordination Of work assignments, to include supervision of ABC Regulatory Agents.

 

DISTINGUISHING FEATURES OF THE WORK

Complexity of Work: Performs work of moderate difficulty which includes performing various types of investigations to determine licensee qualifications or possible violation of ABC or other criminal laws; performing regulatory inspections to determine compliance with the ABC Act, Board regulations and Virginia criminal laws; educating the public on applicable ABC laws, regulations, policies and procedures; arresting suspected violators of ABC or other criminal laws, or persons committing a felony or misdemeanor in the agent’s presence; obtaining and submitting information to officers of the courts for determining probable cause for issuance of search and arrest warrants; preparing for and attending judicial proceedings to present testimony and/or physical evidence obtained during investigations; performing special undercover investigations necessary to allow the Regulatory Agent to infiltrate the criminal element in order to detect violations; obtaining evidence and insuring compliance with ABC and other criminal laws; maintaining required files, records and official reports on regulatory activities; insuring proper care and maintenance of state-issued equipment; and developing and presenting educational and instructional programs regarding the ABC Department and its operations to law enforcement agencies and civic, professional, educational, religious, charitable, and other groups. May be specially assigned to administer and enforce ABC laws and regulations relating to suppliers of alcoholic beverages. May observe ABC stores during holiday and peak seasons to apprehend shoplifters or persons attempting a robbery. May investigate robberies or burglaries of ABC stores and properties.

Supervision Given: Supervision is typically not a factor.

Supervision Received: Receives general supervision from an Assistant Regulatory Supervisor.

Scope: Work affects the compliance with laws, rules and regulations by applicants for ABC licenses, licensees and the general public and the protection and security of state-owned properties, employees, licensees and the general public.

Impact of Actions: Decisions and actions could moderately impact the agency in terms of time, money, services, and public/employee good will. Effective work performance ensures applicable laws and regulations are enforced and properties are adequately protected.

Personal Contacts: Frequent external contact with licensees, the general public and law enforcement personnel in order to enforce laws and regulations, and provide education on ABC laws, regulations, policies and procedures.

 

KNOWLEDGE, SKILLS AND ABILITIES

Knowledge: Working knowledge of investigative and law enforcement techniques, and of ABC statutes and regulations.

Skills: Skill in the use of law enforcement equipment relative to this job.

Abilities: Demonstrated ability to communicate effectively both orally and in writing; to perform inspections for compliance with laws and regulations; to successfully complete law enforcement and other required training; and to exercise apprehension and arrest powers and give court testimony.

 

QUALIFICATIONS GUIDE*

Licenses or Certification: Valid Virginia driver’s license; certification by the Department of Criminal Justice Services.

Education or Training: Graduation from high school or equivalent.

Level and Type of Experience: Experience in general law enforcement or related work activities.

An equivalent combination of training and experience indicating possession of the preceding knowledge and abilities may substitute for this education and experience.
