CLASS CONCEPT/FUNCTION

This is the third and director level class in the State Labor Law Series. Positions in this class plan and direct the State labor law program designed to administer and enforce state laws guaranteeing gainful and safe employment for all employees. This class ensures the enforcement of and compliance with state labor laws by establishing and implementing procedures for the purpose of responding to inquiries; providing interpretations of the law; conducting routine inspections of the work placer investigating complaints; initiating criminal or civil court actions against violators; giving testimony in court; assessing and collecting civil penalties; overseeing issuance of work permits for minors; preparing for publication certain rules and regulations interpreting the laws; publishing internal operating procedures, policy statements, and legal interpretations; maintaining records; and preparing routine reports. This class is distinguished from the State Labor Law Field Supervisor class by its administrative authority over all field enforcement and operations.

 

DISTINGUISHING FEATURES OF THE WORK

Complexity of Work: Performs work of unusual difficulty which involves developing operational procedures and policies of the State labor law program. This class develops and manages the program budget; directs field investigations of complaints from employer work sites, and of accidents involving minors; directs routine inspections, court activity and collection efforts; publishes policies and procedures; drafts proposed legislation and/or rules and regulations published by the Department of Labor and Industry; directs community education programs and public relations programs; and supervises State Labor Law Field Supervisors.

Supervision Given: Supervises State Labor Law Field Supervisors by providing guidance in the interpretation and implementation of program policies, and procedures, and in overseeing field investigations and education services.

Supervision Received: Receives general direction from the agency assistant commissioner. Directs program with considerable independence and consults with supervisor regarding sensitive or unusual issues.

Scope: Activities affect the planning, development, implementation, and evaluation of the State Labor Law Program which affects the provision of protection for all employees and safety for all employed minors in the state.

Impact of Actions: Effective decisions and actions ensure the quality of services provided and the appropriateness of funds expended. Effective management of the program positively affects the livelihood and economic wellbeing of employees; the protection and safety of employed minors; and the operations, employment practices, and costs of employers. Faulty judgments could result in injuries or deaths of minors employed in hazardous occupations, as well as unfair treatment of other employees.

Personal Contacts: Frequent internal and external contacts with company officials, employees, Commonwealth attorneys, private attorneys, school officials, industry groups, chambers of commerce, union representatives, the media, and the general public regarding the provision of information and enforcement of labor laws. Infrequent internal contacts with the General Assembly and the Governor’s Cabinet regarding program status and discussion of significant issues.

 

KNOWLEDGE, SKILLS AND ABILITIES

Knowledge: Comprehensive knowledge of management practices, state labor laws and labor management relations.

Skills: None identified for this class.

Abilities: Demonstrated ability to plan, manage, and evaluate programs; to interpret complex laws and regulations; to analyze complex subjects; to identify and solve problems; to mediate disputes between employers and employees; to develop operating procedures; to interact with all levels of government and private sector officials; to communicate effectively both orally and in writing; to make formal presentations; and to respond to the media.

 

QUALIFICATIONS GUIDE*

Licenses or Certification: None.

Education or Training: Graduation from an accredited college or university with a degree in business, public administration, law, or a related field.

Level and Type of Experience: Considerable executive level program management; and experience in labor law.

An equivalent combination of training and experience indicating possession of the preceding knowledge and abilities may substitute for this education and experience.

 

CLASS HISTORY

This class was revised in January 1989 as a result of the statewide Classification Review/Specification Update Program. It supersedes the class specification for the State Labor Law Program Director class dated December 16, 1981.
