STATE LABOR LAW FIELD SUPERVISOR 74042 A

 

CLASS CONCEPT/FUNCTION

This is the second and supervisory class in the State Labor Law Series. Positions in this class supervise, assign, plan, and review all work of State Labor Law Representatives assigned to a specific geographic area to assure the proper interpretation of labor laws, policies, and procedures. Positions provide training, guidance, and coordination of enforcement functions. This class is distinguished from the State Labor Law Representative class by its supervisory authority. This class is distinguished from the State Labor Law Program Director class by the latter’s authority over the entire labor law division of the Department of Labor and Industry.

 

DISTINGUISHING FEATURES OF THE WORK

Complexity of Work: Performs work of considerable difficulty which involves supervising the work of State Labor Law Representatives; reviewing cases reported by State Labor Law Representatives; and directing the research and investigation of complaints. Provides assistance to prepare both criminal and civil cases for litigation; directs the drafting of warrants, subpoenas, garnishment summonses, levies, interrogatory summonses relative to contested cases, and execution of judgments; reviews federal wage and hour laws and other federal and state laws for impact on the enforcement functions of state labor laws; and ensures the training of personnel on enforcement activities of the division, investigative methods and procedures, judicial processes, and court systems. Provides explanations of labor laws to courts, attorneys, company officials, school groups, and the general public.

Supervision Given: Supervises State Labor Law Representatives in the enforcement of state labor laws. Provides supervision in the use of investigative methods and procedures, and with interpretations of technical laws, warrant, rules and regulations.

Supervision Received: Receives directions from the State Labor Law Program Director. Independently performs most duties and responsibilities of the position in accordance with established policies and procedures.

Scope: Activities affect the working conditions, and the protection of employers and employees and the safety of employed minors in the state.

Impact of Actions: Actions have a serious impact on state or private sector employees and employers of the Commonwealth. Effective supervision of representatives ensures the accurate completion of investigations which results in compliance with labor laws and detection of violations which may result in fines and/or civil or criminal proceedings. Inefficient supervision could be costly in terms of time and money and may lead to inaccurate investigations and/or invalid testimony by representatives which could result in failure to convict law violators.

Personal Contacts: Frequent internal and external contacts with company officials and employees, federal and state officials, commonwealth attorneys, judges, magistrates, clerks of court, Attorney General’s Office and corporate attorneys regarding investigations, violations and legal issues, and various federal and state regulations.

 

KNOWLEDGE, SKILL AND ABILITIES

Knowledge: Considerable knowledge of state and federal labor laws; and of investigative methods and procedures. Working knowledge of judicial processes and multi-court systems; of laws pertaining to employee/employer relations; of methods and techniques of presenting testimonies in criminal actions; and of supervisory practices.

Abilities: Demonstrated ability to train, organize, and supervise a staff of Labor Law Representatives engaged in enforcing and interpreting labor laws, rules, and regulations; reach accurate and workable conclusions; review and analyze data/statistics; communicate effectively orally and in writing; collect facts, figures, and other data to present reports; supervise the work of others; and to evaluate all alternatives available and reach acceptable conclusions to problem situations.

 

QUALIFICATIONS GUIDE*

Licenses or Certification: None.

Education or Training: Graduation from an accredited college or university with studies in law enforcement or a related field.

Level and Type of Experience: Progressively responsible experience involving investigations and law enforcement.

An equivalent combination of training and experience indicating possession of the preceding knowledge and abilities may substitute for this education and experience.

This class was revised in January 1989 as a result of the statewide Classification Review/Specification Update Program. It supersedes the class specification for the State Labor Law Field Supervisor class dated December 1, 1986.
