CLASS CONCEPT/FUNCTION

This is the first class in the State Labor Law Series. Positions in this class enforce state labor laws and serve as representatives of the Department of Labor and Industry in court actions involving state labor law violations in an assigned geographical area. This class is distinguished from the State Labor Law Field Supervisor class by the latter’s supervisory responsibilities.

 

DISTINGUISHING FEATURES OF THE WORK

Complexity of Work: Performs work of considerable difficulty which involves examining records; questioning employers, office personnel, owners, operators, agents, or employees in regard to investigations, inspections, and complaints; mediating disputes; obtaining civil and criminal warrants; recommending civil penalties for child labor violations detected by inspections or by complaints received; consulting with supervisor, lawyers, law enforcement personnel, and commonwealth attorneys regarding investigations; presenting written and verbal testimony in court hearings; and instituting procedures for judgments and collection of wages.

Supervision Given: Supervision is typically not a factor; however, positions in this class may serve in a lead capacity to assist in training labor law trainees.

Supervision Received: Receives general supervision from a State Labor Law Field Supervisor. Performs field work independently. Consultation with the supervisor is expected in unusual situations or for significant cases.

Scope: Activities affect the working conditions of employers and employees, and the safety of employed minors in the state.

Impact of Actions: Actions have moderate impact on state or private sector employees and employers. Effective performance of investigations facilitates compliance with state and federal labor laws and ensures the detection of violations which may result in fines

and/or civil or criminal proceedings. Inaccurate investigations and/or invalid testimony could result in failure to convict law violators.

Personal Contacts: Frequent internal and external contacts with employers and employees, judges, magistrates, clerks of court, corporate attorneys, Commonwealth attorneys, school officials, sheriffs, employer groups, union representatives, state and federal agencies, and the general public regarding inspections and complaints.

 

KNOWLEDGE, SKILLS AND ABILITIES

Knowledge: Working knowledge of state and federal labor laws, related statutes, court procedures, judicial practices, and policies; of different types of work environments; and of mediation methods and techniques.

Abilities: Demonstrated ability to conduct field investigations and prepare investigation reports; to develop court and other documentation; to review information or evidence, and conclude disposition of investigation; to recognize hazards; to effect compliance with labor laws through education and instruction; to communicate effectively orally and in writing with employers, employees, court officials, commonwealth attorneys, private attorneys, school officials, and persons seeking or requesting assistance; to present evidence in civil court actions; to give testimony in criminal court action, and to make oral presentations to groups regarding activities of the division.

 

QUALIFICATIONS GUIDE*

Licenses or Certification: None.

Education or Training: Graduation from an accredited college or university with course work in law enforcement, criminal justice, or a related field.

Level and Type of Experience: Some experience in law enforcement, and/or investigations.

An equivalent combination of training and experience indicating possession of the preceding knowledge and abilities may substitute for this education and experience.

This class was revised in January 1989, as a result of the Statewide Class/Review Specification Update Program. This class specification supersedes the class specification for State Labor Law Representative class dated September 16, 1981.
