CLASS CONCEPT/FUNCTION

This is the first class and the first managerial level in the series of classes for positions that administer right of way programs in agency district offices. Positions in this class are responsible for managing and coordinating the work activities of one or more right of way program units. This class is distinguished from the Transportation District Right of Way Manager by the latter’s responsibility for managing and directing an entire district's right of way program.

 

DISTINGUISHING FEATURES OF THE WORK

Complexity of Work: Performs managerial work of considerable difficulty. Manages one or more right of way program units by implementing program policies, procedures, work techniques, and methods and by planning, directing and coordinating project activities. Prepares justification of administrative settlements; prepares and/or oversees the preparation of appraisal reports; negotiates appraisal and service contracts, time study estimates and the processing of consultants’ bills; oversees the removal of acquired building and other obstacles; prepares justification for settlements of condemnation cases which includes advising attorneys about the feasibility of administrative settlements; administers the coordination between fee attorneys, expert witnesses and agency representatives in court cases; assigns, monitors, evaluates and approves the work of section personnel including consultants by prioritizing and monitoring projects; plans for employee training and development and works to resolve employee relations issues; prepares data for eminent domain proceedings and consults with local and fee attorneys coordinates project activities with turnkey and fee consultants, central and district office personnel; reviews title examinations and the closing of properties being conveyed by deed; determines action to be taken on difficult appraisal, negotiation, and/or relocation cases and issues operative instructions; monitors

project status in order to ensure meeting established advertisement dates; and prepares HRPS manpower needs portion of the budget. Prepares and/or reviews legal documents and gives technical guidance on the development of special agreements for donated right of way.

Supervision Given: Provides general supervision to Transportation Land Acquisition Agents Senior, Transportation Land Acquisition Agents Specialist, Transportation Land Acquisition Agents, Highway District Utility Engineers, Right of Way Technician Supervisors, Right of Way Technicians, and/or office services personnel. Technical supervision is given to consultants and fee appraisers.

Supervision Received: Receives direction from a Transportation Land Acquisition Manager/Field who reviews and evaluates the work in terms of meeting overall goals and objectives.

Scope: The work spans the district operation of one or more right of way program units through managing, planning and monitoring projects and activities to acquire land or other property for the construction and/or maintenance of primary, urban, and secondary transportation systems.

Impact of Actions: Effective job performance results in meeting advertisement and construction schedules. This results in the Commonwealth’s realization of transportation planning goals and objectives. Errors could result in economic harm to property owners, tenants and business owners; the inability of the agency to meet commitments to the public; and delays in the overall right of way program objectives.

 

KNOWLEDGE, SKILLS AND ABILITIES

Knowledge: Considerable knowledge of applicable agency, local, state and federal rules, regulations, policies, and procedures relating to the program areas assigned such as appraisal methods, acquisition and removal of construction conflicts, laws pertaining to real estate conveyances, easements, contracts, eminent domain; of managerial principles and practices; and a working knowledge of surveying and mapping principles.

Abilities: Demonstrated ability to manage and administer program(s) including the identification of financial and human resource needs; plan, coordinate and evaluate the work of others; train and motivate employees; read and understand highway construction plans; interpret program policies and procedures; plan, coordinate and prioritize multiple assignments within scheduled time frames; establish and maintain effective working relationships with local government officials and the public; and communicate effectively both orally and in writing.

 

QUALIFICATIONS GUIDE*

Licenses or Certification: None.

Education or Training: Graduation from an accredited college or university with major course work in real estate or business administration, or a related field.

Level and Type of Experience: Progressively responsible supervisory experience in a related program area.

An equivalent combination of training and experience indicating possession of the preceding knowledge and abilities may substitute for this education and experience.

 

CLASS HISTORY

This class was developed by the Virginia Department of Transportation and validated by the Department of Personnel and Training. It replaces some positions in the Highway Right of Way Manager A class, effective January 1991.
