CLASS CONCEPT/FUNCTION

This is the second class in the Staff Attorney series. Positions specialize in laws applicable to matters pertaining to the assigned agency's operations. Work involves the litigation of cases in court and representation of the state in the full practice of law (Code of Virginia, sections 2.1-121 and 2.1-122). Incumbents decide the course of litigation; determine procedures for reviewing and assessing the status of complaints; file papers for court hearings; defend clients in court; and negotiate settlements. The work is distinguished from the Staff Attorney class by its responsibility for the litigation of cases before federal and state, trial and appellate courts, and various state agency and local administrative bodies.

 

DISTINGUISHING FEATURES OF THE WORK

Complexity of Work: Positions perform work of considerable difficulty in the representation of the state in the full practice of law. Represent clients in the resolution of complaints concerning alleged violations of their legal rights; litigate cases in court; decide the course of litigation; determine procedures for reviewing and assessing the status of each complaint; file papers for court hearings; defend clients in court; and negotiate settlements. Other duties include providing legal advice and technical assistance to field staff, and serving as a resource liaison with law schools and the private bar.

Supervision Given: Supervision is typically not a factor. May supervise the work of clerical staff.

Supervision Received: Receives directions from an administrator or deputy. Performs work independently, developing own work sequences and methods within established policies.

Scope: Work involves federal and state laws, acts, policies, and regulations which have a significant affect on claimant's benefits, settlements, and relief through the enforcement of laws designed for their protection.

Impact of Actions: Serious impact regarding preparing cases for court or to conduct hearings which affect the rights of clients.

Personal Contacts: Frequent external contacts with clients, attorneys, service providers, and state agencies.

 

KNOWLEDGE, SKILLS AND ABILITIES

Knowledge: Considerable knowledge of state and federal laws and regulations affecting service; and of agency operations. Working knowledge of state and federal civil procedures and applicable law.

Skills: None identified for this class.

Abilities: Demonstrated ability to communicate, orally and written; to interview and counsel clients, to prosecute cases effectively; analyze problems and develop solutions; to plan, direct, and implement courses of action; and to work with a variety of agencies and persons with varied disabilities.

 

QUALIFICATIONS GUIDE*

License or Certification: License to practice law in the Commonwealth of Virginia.

Education or Training: Graduation from an accredited school of law.

Level and Type of Experience: Experience in federal and state court litigation and the analysis of legislation pertinent to the work.

An equivalent combination of training and experience indicating possession of the preceding knowledge and abilities may substitute for this education and experience.

 

CLASS HISTORY

This class was developed by a Department of Personnel and Training Analyst. A portion of the positions in the Staff Attorney class will make up this class, effective June 1, 1994.
