CLASS CONCEPT/FUNCTION
This is an agency-unique class used by the Department of General Services Division of Risk Management, which designs, develops, implements, and administers insurance and self-insurance programs for the State. The position in this class develops and manages the claims, Workers' Compensation, tort liability, and loss control programs that provide coverage and claims resolution for all state agencies, political subdivisions, and local elected constitutional officers. This class is distinguished from the State Insurance Program Manager class by the number and complexity of the programs it administers; the responsibility for all insurance and self-insurance program litigation; and the authority for negotiation, contracts, and claims settlements made by the Senior level class.
DISTINGUISHING FEATURES OF THE WORK
Complexity of Work: Performs work of unusual difficulty in developing, implementing, and administering the state's claims, Workers' Compensation, tort liability, and loss control programs administered by the Division of Risk Management. Responsible for directing the program management of all claims programs, which includes formulating, designing, implementing, and interpreting statewide policies and procedures; and directing the management of claims units and staff. Directs the Workers' Compensation and claims programs planning, evaluation, contingency planning, litigation management, contract management, fiscal management, cost and premium allocation, and public relations. Other duties include providing guidance and direction to the Department of Mental Health and Mental Retardation and the Department of Corrections, authorizing and approving their safety engineer budgets, goals, and objectives, and monitoring results to assure successful reduction in agency losses; providing guidance and direction to the Division of Risk Management's Safety Engineer; delegating authority to staff and approving settlements and legal expenses up to policy limits; and authorizing goods and services expenditures above those delegated to claims management teams. Also analyzes management reports submitted by claims supervisors, third party claims administrator, the agency fiscal office, and contract actuary; develops annual financial report of reserves and contingent liabilities for inclusion in the State Comptroller's Comprehensive Annual Financial Report; and develops recommendations for changes in state law and policies.
Supervision Given: The position provides goals and direction for the assigned program areas of statewide insurance and self-insurance programs and provides direction to Insurance Program Supervisors, Safety Engineers, Insurance Claims Adjusters-Workers' Compensation, Insurance Program Specialists, and other insurance support personnel.
Supervision Received: Receives general direction in the form of objectives and program outlines from the director of the Division of Risk Management. Has authority to spend amounts limited only by statute on claims settlements and judgments.
Scope: The programs managed are statewide insurance and self-insurance programs for state agencies and political sub-divisions.
Impact of Actions: Positions in this class have a major effect on the continuity, compliance, and quality of the insurance and self-insured programs managed for the state, as well as on loss control, negotiation and settlement of contracts and claims, litigation, and the projection and management of sufficient program funding and cost containment.
Personal Contacts: Frequent internal and external contacts with state and local agencies and government officials; the Office of the Attorney General; and private attorneys, insurance agencies, and service providers, to provide information concerning program activities, procedures, and policies; compliance requirements, legal issues, and contract and claim negotiations and resolution.
KNOWLEDGE, SKILLS AND ABILITIES
Knowledge: Comprehensive knowledge of the Virginia Workers' Compensation Act; related state and federal tort and constitutional laws; and insured and self-insured claims and litigation management. Considerable knowledge of property and casualty insurance policies, risk management principles and practices, project management, negotiation techniques, and risk control; contract administration and procedures; and procurement policies and procedures.

Abilities: Demonstrated ability to develop and administer complex claims and litigation management programs; read and interpret property and casualty insurance policies; collect and analyze data and reach logical conclusions; make presentations before diverse groups; communicate well, orally and in writing; and interpret case law.
QUALIFICATIONS GUIDE*
License or Certification: None.
Education or Training: Graduation from an accredited college or university with major studies in public or business administration, or related field.
Level and Type of Experience: Experience in administering Workers' Compensation, personal property, and constitutional medical malpractice tort claims and litigation management programs; administering self-insurance programs; establishing policies, procedures, and guidelines for a diverse organization; and contract management.
An equivalent combination of training and experience indicating possession of the preceding knowledge and abilities may substitute for this education and experience.
